1. Purpose

The purpose of the General Terms and Conditions of Sale (hereinafter "GTCS") is to define the rights and obligations of BERSUB and its customers in connection with the sale of lighting products for scuba diving (hereinafter "the Products") in France and abroad.

3. Acceptance of T&Cs

Any order placed on the BERSUB website implies unreserved acceptance of these GTC. 

4. Offer validity

The items shown on the site are available while stocks last.
En cas de débit ou d’encaissement visant la commande d’un article indisponible, BERSUB s’engage à proposer un avoir ou à rembourser le client dans un délai de 15 jours. BERSUB s’engage à prévenir par courrier électronique le client qui aurait passé commande d’un article indisponible.

5. Payment

The types of payment offered are : 

Credit card: Payment directly on www.bersub.com via La Banque CIC.

PayPal : Directly on the site www.bersub.com via PayPal's payment module. Bersub does not collect any data and has no access to login/password information.

Bank transfer: Please contact us directly by e-mail or telephone for this type of transfer.

The order will only be considered effective once the relevant bank payment centers have given their approval.

BERSUB reserves the right to request any proof of address in the name of the person who placed the order and/or the person who has the delivery address. These requests will be made by e-mail if necessary.

6. Awards

Product prices are indicated in euros, all taxes included (TTC), excluding shipping costs for metropolitan France and European Union member countries.

The price of products for French overseas departments and territories and the rest of the world is indicated in € inclusive of all taxes (French VAT 20%).

They will be displayed and billed tax-free after you have registered your delivery address (before payment).

All orders placed on the Site and delivered to French overseas departments and territories and the rest of the world may be subject to any taxes and customs duties imposed when the package reaches its destination. These customs duties and taxes are the responsibility of the customer. We are not obliged to check and inform you of applicable customs duties and taxes. Please note that by ordering from the Site, you are considered the importer of record and are required to comply with all laws and regulations of the country where you will receive the goods. We would like our customers to be aware that cross-border deliveries may be subject to opening and inspection by customs authorities. 

BERSUB reserves the right to modify its prices at any time, but the Products will be invoiced on the basis of the prices in force at the time the order is validated.

7. Delivery

7.1 Delivery services :

BERSUB livre ses Produits en France et à l’international (Voir la liste des pays livrables -liens vers fichier drive quand il sera fait). Les délais de livraison sont donnés à titre indicatif et peuvent varier en fonction de la destination. BERSUB ne pourra être tenue responsable des retards de livraison imputables aux services postaux ou aux transporteurs.

Deliveries in mainland France are made by DPD in pick-up relays or at home, or by Mondial Relay.

Deliveries in Europe (excluding France) are made by DPD home delivery.

Deliveries in Switzerland and the rest of the world are made by TNT home delivery.

Home deliveries to French overseas departments and territories are made by Colissimo and TNT.

Deliveries for purchases under €30 will be made by post or DPD in France, Dom-Tom and Europe.

Les frais de port sont offerts pour tous les pays (voir liste) à partir de 900€.

7.2 Availability :

En stock : Expédition de la commande sous 1 à 3 jours ouvrés pour une commande validée avant 14h. En cas de non-disponibilité, le client sera prévenu du nouveau délai de livraison. Le client pourra refuser et être remboursé de son achat sous un délai de 15 jours maximum.

Available within 3 to 5 days: Order dispatch within 3 to 5 working days for orders validated before 2pm.

Available to order: the customer will be informed of the delivery time within 2 working days. The customer may refuse and be reimbursed by bank transfer within a maximum of 15 days if the delivery time is inconvenient.

Out of stock: Product discontinued or replaced.

8. Products

The Products offered for sale are those listed on the BERSUB website on the day of consultation by the Customer. The essential characteristics of the Products are described and presented as accurately as possible. The photos of the products are as realistic as possible, but they are not binding. 

9. Withdrawal

In accordance with French law, the Customer has a period of 14 days from receipt of the Products to exercise his right of withdrawal without having to justify his reasons or pay any penalties. Products must be returned in their original, undamaged condition and packaging.

BERSUB headlight bags are closed with a safety collar. If the collar is removed, the product cannot be returned. The model name and color are displayed on the outside of the bag.

Return postage costs are at the customer's expense and the product must be returned to the following address: BERSUB - 235 ZA du Jasmin - 73240 St-Genix-sur-Guiers.
