The purpose of these General Terms and Conditions of Sale (GTCS) is to define the rights and obligations of BERSUB and its customers in the context of the sale of lighting products for scuba diving (hereinafter referred to as «the Products») in France and abroad.

3. Acceptance of the GTCS
Any order placed on the BERSUB website implies unreserved acceptance of these GTC.
4. Validity of offers
Les articles visibles sur le site sont disponibles jusqu’à l’épuisement des stocks.
En cas de débit ou d’encaissement visant la commande d’un article indisponible, BERSUB s’engage à proposer un avoir ou à rembourser le client dans un délai de 15 jours. BERSUB s’engage à prévenir par courrier électronique le client qui aurait passé commande d’un article indisponible.
5. Payment
The following types of payment are available:
Credit card: Payment directly on the www.bersub.com website via La Banque CIC.
PayPal and Paypal 4x free of charge: Directly on the site www.bersub.com via the PayPal payment module. Bersub does not collect any data and does not have access to login/password information.
Bank transfer: Please contact us directly by e-mail or telephone for this type of transfer.
The order will only be considered effective once the relevant bank payment centres have given their approval.
BERSUB reserves the right to request all proof of address in the name of the person who placed the order and/or the person who has the delivery address. These requests will be made by e-mail if necessary.
6. Awards
Product prices are indicated in euros, inclusive of all taxes (VAT), excluding delivery costs for metropolitan France and European Union member states.

Product prices for French overseas departments and territories and the rest of the world are quoted in € inclusive of all taxes (French VAT 20%).
They will be displayed and charged duty-free after you have registered your delivery address (before payment).
Any order placed on the Site and delivered to the French overseas departments and territories and the rest of the world may be subject to possible taxes and customs duties which are imposed when the parcel reaches its destination. Any such customs duties and taxes relating to the delivery of an item shall be borne by the customer and shall be your responsibility. We are not obliged to check and inform you of the customs duties and taxes applicable. Please note that by ordering from the Site, you are considered to be the importer of record and are responsible for complying with all laws and regulations of the country in which you will receive the goods. We would like our customers to be aware that cross-border deliveries may be subject to opening and inspection by customs authorities.
BERSUB reserves the right to modify its prices at any time, but the Products will be invoiced on the basis of the prices in force at the time the order is validated.
7. Delivery
7.1 Delivery services :
BERSUB delivers its products in France and abroad. Delivery times are given as an indication and may vary depending on the destination. BERSUB cannot be held responsible for delays in delivery attributable to the postal services or carriers.
Deliveries in mainland France are made by DPD in a pick-up relay or at home or by Mondial Relay.
Deliveries in Europe (excluding France) are made by DPD home delivery.
Deliveries in Switzerland and the rest of the world are made by TNT home delivery.
Deliveries to French overseas departments and territories are made by Colissimo and TNT for home delivery.
Deliveries for purchases under €30 will be made by post or DPD in France, French overseas departments and territories and Europe.
Postage is free for mainland France and certain European countries. for purchases over €200.
Free postage to all countries from €900.
7.2 Availability :
In stock: Order dispatched within 1 to 3 working days for orders validated before 2pm. In the event of unavailability, the customer will be informed of the new delivery date. The customer may refuse the order and be reimbursed within 15 days. maximum.
Available within 3 to 5 days: Order dispatched within 3 to 5 working days for orders validated before 2pm.
Available to order: the customer will be informed of the delivery time within 2 working days. The customer may refuse and be reimbursed for their purchase by bank transfer within a maximum of 15 days if the delivery time is not to their satisfaction.
Out of stock: Product discontinued or replaced.
8. Products
The Products offered for sale are those appearing on the BERSUB website on the day of consultation by the Customer. The essential characteristics of the Products are described and presented as accurately as possible. The photos of the Products are as realistic as possible, but they are not
9. Withdrawal
In accordance with French legislation, the Customer has a period of 14 days from receipt of the Products to exercise his right of withdrawal without having to justify his decision or pay any penalties. Products must be returned in their original, undamaged condition and packaging.
Ask us for a Return Authorisation Form before any shipment.
BERSUB headlight bags are closed with a safety collar. The product will not benefit from the right of withdrawal if this is removed. The model name and colour are displayed on the outside of the bag.

10. Guarantee
Le vendeur délivre un bien conforme au contrat ainsi qu’aux critères énoncés à l’article L. 217-5.
Il répond des défauts de conformité existant au moment de la délivrance du bien au sens de l’article L. 216-1, which appear within a period of two years from the date on which they were notified.
BERSUB offers you several choices of manufacturer's warranty for its BERSUB brand products, as well as for the DIVEPRO and LIGHT X brands.
Guarantee only for BERSUB products
2-year Bronze warranty
Purpose of the Guarantee
This Bronze Warranty is offered by BERSUB and exclusively covers defects in the mechanical and electronic components of our products for a period of 2 years from the date of original purchase, subject to the conditions set out below.
Scope of the Guarantee
BERSUB undertakes to repair or replace, free of charge* to the consumer, any parts that are defective or damaged due to manufacturing or material defects. This warranty specifically covers :
- Mechanical problems Malfunctions affecting mechanical systems caused by design or manufacturing faults.
- Electronic problems : failure of internal electronic components (circuit boards, LEDs, etc.) resulting from manufacturing defects.
- Battery 2 years or more, depending on the warranty chosen.
Warranty conditions
- The guarantee only applies if the product has been used in accordance with the manufacturer's recommendations and instructions, as set out in the user manual.
- Repairs under warranty will be carried out exclusively by BERSUB].
- If the product cannot be repaired, BERSUB reserves the right to replace the product with a similar model or one of equivalent value.
Exclusions
This warranty does not cover :

- Any damage caused by external factors such as electrical surges or mechanical shocks.
- Any use of the product not intended for the purpose for which it was designed
Complaints procedure In the event of a breakdown or malfunction covered by this warranty, the customer must :
- Contact our after-sales service via the contact form by providing the product serial number, proof of purchase and a detailed description of the problem encountered.
- Send or bring the complete product (lamp + charger + battery) to the shop where the product was purchased.
Limits of the Guarantee Cette garantie est limitée à la réparation ou au remplacement des pièces défectueuses comme décrit ci-dessus. BERSUB ne sera pas responsable de toute perte de données, du temps d’arrêt, ou des dommages indirects, accidentels ou consécutifs résultant de l’utilisation ou de l’impossibilité d’utiliser le produit.
Period of validity The Bronze warranty is valid for a period of 2 years from the date of purchase. After expiry of this period, any repair or replacement will be subject to a quotation.
Transfer of Ownership This guarantee is transferable to a new user if the product is resold, provided that the initial guarantee period has not expired and that the new user presents the original proof of purchase.
3-year GOLD warranty (Free)
Purpose of the Guarantee

Terms and conditions: FREE
- You must register your product on the website BERSUB 30 days maximum after the date of purchase).
- Newsletter subscription (non-intrusive)
BERSUB offers you a one-year extension to your original manufacturer's warranty, covering the same conditions. This extension extends the protection of your product against mechanical and electronic defects for a total of 3 years from the date of purchase.
For any claim or repair during the period of this extension, please follow the same procedure as described in your original warranty.

5-year Platinum warranty
Purpose of the Guarantee
Extension de la garantie Bronze – 3 années supplémentaires
Terms and conditions: Chargeable only on the website BERSUB
- You must register your product on the website BERSUB 30 days maximum after the date of purchase).
BERSUB offers you a paid warranty extension for a further 3 years, in addition to the initial Bronze warranty. This extended warranty covers the same mechanical and electronic defects as the original warranty, for a total of 5 years from the date of purchase.
Opt for this additional warranty for ongoing protection of your product and benefit from free repairs or replacements* in the event of a covered breakdown, under the same conditions as the manufacturer's warranty.
*(excluding carriage costs, which are payable by the customer for the return to the factory)

Warranty only for DIVEPRO and LIGHT-X products
DIVEPRO products that have not been purchased in the BERSUB network (France and Switzerland) cannot be handled by BERSUB and must be returned to the country of original purchase.
2-year Bronze warranty

This Bronze warranty is offered by BERSUB and exclusively covers defects related to the mechanical and electronic components of the DIVEPRO and LIGHT X products for a period of 2 years from the date of initial purchase, subject to the conditions defined below.
Scope of the Guarantee
BERSUB undertakes to repair or replace, free of charge* to the consumer, any parts that are defective or damaged due to manufacturing or material defects. This warranty specifically covers :
- Mechanical problems Malfunctions affecting mechanical systems caused by design or manufacturing faults.

- Battery1-year guarantee

BERSUB offers you a paid warranty extension for 1 additional year, in addition to the initial Bronze warranty. This extended warranty covers the same mechanical and electronic faults as the original warranty (excluding the battery), for a total of 3 years from the date of purchase.
Opt for this additional warranty for ongoing protection of your product and benefit from free repairs or replacements* in the event of a covered breakdown, under the same conditions as the manufacturer's warranty.

11. Protection of personal data (RGPD)
In application of the General Data Protection Regulation (RGPD), the Vendor undertakes to protect the Customer's personal data. The information collected at the time of the order is necessary for the management of the transaction and may be communicated in whole or in part to the Vendor's service providers involved in the execution of the order. Customers have the right to access, rectify, delete and oppose any personal data concerning them. 12. Intellectual property rights
All elements of the BERSUB website are and remain the exclusive intellectual property of the Company. No one is authorised to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site.
