The purpose of these General Terms and Conditions of Sale (GTCS) is to define the rights and obligations of BERSUB and its customers in the context of the sale of lighting products for scuba diving (hereinafter referred to as \u00abthe Products\u00bb) in France and abroad.<\/span><\/p>

3. Acceptance of the GTCS<\/b><\/h4>

Any order placed on the BERSUB website implies unreserved acceptance of these GTC.\u00a0<\/span><\/p>


4. <\/b>Validity of offers<\/b><\/h4>

<\/span>En cas de d\u00e9bit ou d\u2019encaissement visant la commande d\u2019un article indisponible, BERSUB s\u2019engage \u00e0 proposer un avoir ou \u00e0 rembourser le client dans un d\u00e9lai de 15 jours. <\/span>BERSUB s\u2019engage \u00e0 pr\u00e9venir par courrier \u00e9lectronique le client qui aurait pass\u00e9 commande d\u2019un article indisponible.<\/span><\/p>


5. <\/b>Payment<\/b><\/h4>

The following types of payment are available:\u00a0<\/span><\/p>

Credit card: Payment directly on the www.bersub.com website via La Banque CIC.<\/span><\/p>

PayPal and Paypal 4x free of charge: Directly on the site <\/span>www.bersub.com<\/span><\/a> via the PayPal payment module. Bersub does not collect any data and does not have access to login\/password information.<\/span><\/p>

Bank transfer: Please contact us directly by e-mail or telephone for this type of transfer.<\/span><\/p>

The order will only be considered effective once the relevant bank payment centres have given their approval.<\/span><\/p>

BERSUB reserves the right to request all proof of address in the name of the person who placed the order and\/or the person who has the delivery address. These requests will be made by e-mail if necessary. <\/span><\/p>


6. Awards<\/b><\/h4>

Product prices are indicated in euros, inclusive of all taxes (VAT), excluding delivery costs for metropolitan France and European Union member states.<\/span><\/p>

Product prices for French overseas departments and territories and the rest of the world are quoted in \u20ac inclusive of all taxes (French VAT 20%).<\/span><\/p>

They will be displayed and charged duty-free after you have registered your delivery address (before payment).<\/span><\/p>

Any order placed on the Site and delivered to the French overseas departments and territories and the rest of the world may be subject to possible taxes and customs duties which are imposed when the parcel reaches its destination. Any such customs duties and taxes relating to the delivery of an item shall be borne by the customer and shall be your responsibility. We are not obliged to check and inform you of the customs duties and taxes applicable. Please note that by ordering from the Site, you are considered to be the importer of record and are responsible for complying with all laws and regulations of the country in which you will receive the goods. We would like our customers to be aware that cross-border deliveries may be subject to opening and inspection by customs authorities.<\/span>\u00a0<\/span><\/p>

BERSUB reserves the right to modify its prices at any time, but the Products will be invoiced on the basis of the prices in force at the time the order is validated.<\/span><\/p>


7. Delivery<\/b><\/h4>
7.1 Delivery services :<\/b><\/h5>

BERSUB delivers its products in France and abroad.<\/span>\u00a0Delivery times are given as an indication and may vary depending on the destination. BERSUB cannot be held responsible for delays in delivery attributable to the postal services or carriers.<\/span><\/p>

Deliveries in mainland France are made by DPD in a pick-up relay or at home or by Mondial Relay.<\/span><\/p>

Deliveries in Europe (excluding France) are made by DPD home delivery.<\/span><\/p>

Deliveries in Switzerland and the rest of the world are made by TNT home delivery.<\/span><\/p>

Deliveries to French overseas departments and territories are made by Colissimo and TNT for home delivery.<\/span><\/p>

Deliveries for purchases under \u20ac30 will be made by post or DPD in France, French overseas departments and territories and Europe.<\/span><\/p>

Postage is free for mainland France and certain European countries. <\/span>for purchases over \u20ac200.<\/span><\/p>

Free postage to all countries <\/span>from \u20ac900.<\/span><\/p>


7.2 Availability :<\/b><\/h5>

In stock: Order dispatched within 1 to 3 working days for orders validated before 2pm. In the event of unavailability, the customer will be informed of the new delivery date. The customer may refuse the order and be reimbursed within 15 days. <\/span>maximum.<\/span><\/p>

Available within 3 to 5 days: Order dispatched within 3 to 5 working days for orders validated before 2pm.<\/span><\/p>

Available to order: the customer will be informed of the delivery time within 2 working days. The customer may refuse and be reimbursed for their purchase by bank transfer within a maximum of 15 days if the delivery time is not to their satisfaction.<\/span><\/p>

Out of stock: Product discontinued or replaced.<\/span><\/p>


8. Products<\/b><\/h4>

The Products offered for sale are those appearing on the BERSUB website on the day of consultation by the Customer. The essential characteristics of the Products are described and presented as accurately as possible. The photos of the Products are as realistic as possible, but they are not\u00a0<\/span><\/p>


9. Withdrawal<\/b><\/h4>

In accordance with French legislation, the Customer has a period of 14 days from receipt of the Products to exercise his right of withdrawal without having to justify his decision or pay any penalties. Products must be returned in their original, undamaged condition and packaging.\u00a0<\/span><\/p>

Ask us for a Return Authorisation Form before any shipment.<\/p>

BERSUB headlight bags are closed with a safety collar. The product will not benefit from the right of withdrawal if this is removed. The model name and colour are displayed on the outside of the bag.<\/span><\/p>

10. Guarantee<\/b><\/h4>

Le vendeur d\u00e9livre un bien conforme au contrat ainsi qu\u2019aux crit\u00e8res \u00e9nonc\u00e9s \u00e0 l\u2019article <\/span>L. 217-5<\/span><\/a>.<\/span><\/p>

Il r\u00e9pond des d\u00e9fauts de conformit\u00e9 existant au moment de la d\u00e9livrance du bien au sens de l\u2019article <\/span>L. 216-1<\/span><\/a>, which appear within a period of two years from the date on which they were notified.<\/span><\/p>

Purpose of the Guarantee<\/span>
<\/span>This Bronze Warranty is offered by BERSUB and exclusively covers defects in the mechanical and electronic components of our products for a period of 2 years from the date of original purchase, subject to the conditions set out below.<\/p>

Scope of the Guarantee<\/span>
<\/span>BERSUB undertakes to repair or replace, free of charge* to the consumer, any parts that are defective or damaged due to manufacturing or material defects. This warranty specifically covers :<\/p>
